Terms of sales

The General Terms and Conditions of Sale and the Special Terms and Conditions form an integral part of the Sales Contract and the global acceptance of which is mandatory before the conclusion of any sale. The reservation request implies adherence to these conditions of sale and full and unreserved acceptance of their provisions.

1° Terms of sales

1.1 – Application

These terms of sales apply to sales transactions concluded by the Hôtel de la Porte Saint-Malo.

1.2 – Capacity

Any guest of the Hotel de la Porte Saint-Malo acknowledges having the ability to contract, that is to say having the legal majority and not being under curatorship or guardianship.

1.3 – Price

Prices are in Euros. VAT is always included. The prices indicated only include the services strictly mentioned in the reservation. To the price mentioned in the reservation will be added, when invoiced, the additional services provided by the hotelier during the stay and the tourist tax.

The applicable prices are those in force on the day of booking. The hotelier is free to vary his prices at any time. Also, the price displayed during a visit on the website of the Hotel de la Porte Saint-Malo is only valid for orders taken during the duration of its display. Only the price indicated in the booking confirmation is contractual.

1.4 – Terms of Payment

Payment methods depend on the type of reservation made:
If it is a reservation made directly on our site, by phone, the payment of all services is made, during the stay, directly to the hotel. A deposit may be requested when booking.

1.5 – Claims

Any complaint must be made to the hotelier within 30 days from the date of stay.

1.6 – Responsibility

The liability of the hotel is unlimited in case of theft of goods or objects when they have been entrusted to its custody only.

1.7 – Information Technology and Freedoms

In application of the law L.78-17 of 6 January 1978, the customer is informed that the nominative information communicated to the Hotel de la Porte Saint-Malo is subject to computerized processing via our reservation system provider.

The customer has at any time a right of access, rectification or deletion at the hotel Porte Saint-Malo.

The information requested during the reservation is essential for the proper processing of your request. The only recipients of this information are the hotelier concerned by the reservation request.

1.8 – Applicable Law

Any dispute, claim or dispute relating to the terms of booking a stay or a hotel room are subject to French law.

2° Booking conditions

2.1 – Booking Conditions

In order to guarantee its reservation, the customer is asked to communicate his credit card number, the transmission being by secure mode, the entire payment of the stay is made directly to the hotelier.

Guests are asked to arrive at the hotel before 21:00 and to inform the hotel in case of late arrival.

2.2 – Changing a Reservation

Any request to change a reservation must be made to the hotel – by phone 02.96.39.19.76, by email to info@hotelportemalo.com or directly from your confirmation email.

Requests for changes must be made 48 hours before the arrival date.
Requests for changes may result, if applicable, in the application of the cancellation conditions.

2.3 – Cancellation Conditions
2.3.1 GENERAL CONDITIONS FOR CANCELLATION

Cancellation 48 hours before arrival date: No charge.
Cancellation Within 48 hours of arrival.: Billing for one night.
No show: Full billing of your reservation.

IMPORTANT :

All reservations must be guaranteed by credit card.
Your card is not debited when booking.
Payment will be made at the hotel upon check-in.

2.3.2 GROUP CANCELLATION CONDITIONS (specific to each request)

Conditions will be specified in the booking confirmation email.
Reservations are considered «Group» from 5 rooms.
For any request for a Group booking, please contact us to make a quote and present the cancellation conditions that apply,

DEPOSIT :

The percentage of the deposit requested will be calculated according to the total amount of the reservation.

2.3.3 CONDITIONS CANCELLATION LONG STAY + SPECIAL EVENTS (Route du Rhum, Festival of the ramparts, etc.)

Reservations are considered «stay» from 5 nights.

Cancellation 5 days before arrival date: Free of charge.
Cancellation Within 5 days of arrival: Facturation de 30 % du montant total de la réservation.
No show: Full billing of your reservation.

2.4 – Responsability

These conditions of sale are subject to French law and the jurisdiction of the court of Dinan.

2.5 – Withdrawal

As part of the provision of accommodation services offered by the Hotel de la Porte Saint-Malo, pursuant to the provisions of article L.121-21-8 12°of the Consumer Code, no right of withdrawal may be exercised by the customer.

3° Provision of Services

The Services booked by the Client, which include hotel room reservation services and related services will be provided in the following ways, in the conditions provided for in these General Conditions of Sale supplemented by the Conditions of Sale of the Tariff which the Customer has read and accepted when booking on the Hotel’s website

3.1 Non-Smoking Hotel

The Hotel is a completely non-smoking area. The guest shall be liable for direct and/or indirect, consequential damages resulting from the act of smoking in the Hotel. It will therefore be liable for the full amount of the cost of cleaning and restoring the original condition of the damaged element or space.

3.2 Pets

Pets, as long as they are kept on a leash in the common areas of the establishment, can be accepted according to the policy in force of the Hotel with the payment of a supplement. For hygiene reasons, pets are not allowed in the dining rooms.

3.3 Client Responsibilities
3.3.1 Liability in the event of theft

The personal effects of the Client left in the Hotel room, especially outside the safe or in the public areas of the Hotel are his sole responsibility. The Hotel cannot be held responsible for loss, theft, damage or damage caused to said effects.

3.3.2: Responsibility as a good father

The guest accepts and undertakes to use the room as a good father. Also any behavior contrary to morality and public order will cause the Hotel to ask the Customer to leave the establishment without any compensation and or without any refund if a payment has already been made. In the event that no payment has yet been made, the customer must pay the price of the nights consumed before leaving the establishment.

3.3.3 Liability for damage

The Client will be held responsible for all direct and/or indirect damages, of which he is the author, found in the room reserved or that he could cause within the Hotel. Accordingly, it undertakes to compensate the Hotel for the amount of said damages, without prejudice to any damages that may be due, costs of proceedings and lawyers incurred by the Hotel.

3.4 Arrival and departure times

Unless otherwise expressly provided, the Room will be made available to the Client on the day of arrival at 3 pm and the Client will leave the room on the day of departure at 11 am. Otherwise, an additional night will be charged to the Client. The Customer must check his departure date. In case of early departure, a fee equivalent to one night will be charged, unless the Client has notified the Hotel at least 24 hours before departure.

3.5 Relocation

In the event of an exceptional event, case of force majeure or impossibility to make the reserved room available to the Client, the Hotel reserves the possibility of having the Client fully or partially accommodated in a hotel of equivalent category, for services of the same nature and subject to the Client’s prior consent.
